Introduction and Definitions

These Repairer Terms and Conditions (“Terms“) govern the relationship between Axioma Europe Ltd  (“Axioma”, “we,” “us,” or “our“) and repairers (“you” or “Repairer“) who use the AXIOMA platform to provide vehicle repair and maintenance services (the “Services“) to customers (“Drivers“). By registering as a Repairer on our platform, you agree to be bound by these Terms.

In these Terms, the “AXIOMA Service” refers to the platform and services we provide, which include connecting Drivers with Repairers, facilitating service Bookings, providing Job Estimates, and processing payments.

A “Job Estimate” is the estimate which we create for the repair work required for a particular Driver and which we make available to a Repairer through our platform.  

A “Booking” is the contract formed when you accept a Job Estimate. It is a contract which you enter into directly with the Driver. We are not a party to any Booking contract.

 

Repairer Obligations

As a Repairer, you agree to:

  • Comply with the AXIOMA Code of Conduct, which outlines the expected quality and professionalism standards.
  • Complete the jobs accepted through our platform promptly and efficiently, and communicate any necessary changes or delays to both the Driver and us.
  • Use the personal data of Drivers in compliance with applicable data protection legislation.

 

AXIOMA Obligations

We will provide you with Job Estimates and, where Bookings are created,  payment processing services. However, we cannot and do not guarantee a specific volume or frequency of work.

 

Quoting and Pricing

We calculate Job Estimates based on our expert assessment of photos that Drivers provide. If a job requires a small amount of additional work beyond the initial estimate, you agree to accept the risk and perform the additional work without extra compensation. However, if the additional work required is significant, you should promptly notify the Driver and us, so we can renegotiate the terms with the Driver on your behalf.

 

Repair Scheduling and Timeliness

Once a Booking has been created, it is your responsibility to contact the Driver promptly to schedule a repair date. To maintain a high standard of service, we require that you schedule the repair within a reasonable time frame and no later than 24 hours following the Booking, except where delay by the Driver makes this impossible . Delays in scheduling the repair may negatively impact our service’s reputation and may result in termination of your access to the Axioma platform. We reserve the right to monitor and enforce compliance with this requirement at our discretion.

 

Lifetime Warranty on Repairs

  • As a Repairer, you are required to provide a lifetime warranty on the repairs you perform, as set out below in clause 2.
  • All work booked through Axioma must be accompanied by a lifetime guarantee on parts and labour provided by you, the Repairer. All repair services under a booking made on Axioma, including all parts supplied, must be free from defects in (i) materials and (ii) workmanship. The maximum amount of liability for any warranty claim related to the repair service you provide through our platform shall be limited to the total amount paid for the repair service. This limitation applies to any damages, losses, expenses, or costs incurred as a result of the repair service, including but not limited to any costs associated with remedying defects, completing incomplete work, or engaging a third-party repair service. As a Repairer, you are responsible for honouring this warranty and addressing any warranty claims made by the Driver in a timely and satisfactory manner.
  • In the event that a Driver is not satisfied with the repair service provided, they should first return to the Repairer to address the issue and attempt to resolve it. If the Driver remains unsatisfied after giving the Repairer a reasonable opportunity to rectify the problem, the Repairer agrees, within the bounds of reason, to offer the Driver a discount on the repair service. This discount may range from a partial reduction up to forfeiting the full amount of the repair, depending on the nature and severity of the issue. Axioma will actively support and assist both the Driver and the Repairer in finding a fair and reasonable resolution in such situations. The Repairer is responsible for working with the Driver and Axioma to reach an agreeable outcome.

 

Data Protection

Both you and AXIOMA have obligations as data controllers under applicable data protection legislation. You agree to use the personal data of Drivers only for the purpose of fulfilling your obligations under these Terms and in accordance with our Privacy Policy.

 

Liability

Our liability to you is limited to direct losses resulting from our breach of these Terms, capped at £10,000 or the total amount paid to you for the relevant job, whichever is lower. We are not liable for any indirect, incidental, or consequential losses.

 

Non-Circumvention

You agree not to circumvent our platform by entering into separate agreements with Drivers. If you breach this clause we shall be entitled to impose a compensation charge of £1000, which you agree represents a reasonable estimate of our likely loss caused by your breach.

 

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.

 

General

  • If any provision of these Terms is found to be invalid or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
  • Axioma’s failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by Axioma in writing.
  • These Terms constitute the entire agreement between the Repairer and Axioma with respect to the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the Repairer and Axioma with respect to the Axioma Services.
  • Any notices or other communications provided by Axioma under these will be given by posting to the Axioma platform, through email, or by any other means deemed appropriate by Axioma.
  • The Repairer may not assign their rights or obligations under these Terms without the prior written consent of Axioma. Axioma may assign its rights and obligations under these Terms at any time.
  • All intellectual property rights in the Axioma Service and our platform remain owned by, or validly licensed to, Axioma.
